Terms of Service

These Terms of Service (“Terms”) govern your use of the CallFly service (“the Services”). The Services are operated by Crater Creative, LLC, an Ohio limited liability company. If you have any questions concerning the Terms, please address them to [email protected] prior to any use of the Services.

By using CallFly, you agree to the following terms. Breach of these terms may result in your call being deleted from CallFly without a refund (if applicable), and/or a ban on your phone number from being used with CallFly in the future.

Never make emergency calls with CallFly. CallFly is not designed for emergency calls of any kind, especially 911 calls. CallFly calls may convey inaccurate or misleading information to emergency services.

You agree that you will not use CallFly for any reason, or in any way, that is in violation of local, state, or federal law, that is intended to harass or defame any person, that will interfere with or disrupt the Services, or that is intended to or substantially likely to cause harm to any person, property or business entity. You agree that you will not resell or attempt to resell the Services in any fashion.

You agree that you will not transmit material through, or store material on, CallFly that is of a sexual or suggestive nature, obscene, defamatory, intended for the purpose of harassment, or prohibited by law. You acknowledge that CallFly does not warrant that it is suitable for the secure storage or transmission of protected health information, and that it is not intended for the purpose of storing or transmitting protected health information.

You understand that you are solely responsible for determining whether your use of CallFly, or storage of information in CallFly, is permissible under federal, state, and local law, and for compliance with applicable law governing phone/voice call recording and the transmission and storage of such recordings, and that CallFly accepts no liability for violation of law or regulations on your part.

CallFly makes no representation that the Services are appropriate for use or available for use in locations outside the United States. If you choose to access CallFly from a location outside the United States, you do so on your own initiative and you are responsible for compliance with local laws.

The Services are provided “AS IS”. CallFly makes no express warranties or guarantees about the Services. TO THE EXTENT PERMITTED BY LAW, CALLFLY DISCLAIMS IMPLIED WARRANTIES, INCLUDING ANY WARRANTY THAT THE SITE IS OR WILL BE MERCHANTABLE, OF SATISFACTORY QUALITY, ACCURATE, TIMELY, FIT FOR A PARTICULAR PURPOSE OR NEED, OR NON-INFRINGING UPON THE RIGHTS OF A THIRD PARTY. CALLFLY DOES NOT GUARANTEE THAT THE SERVICES WILL MEET THE REQUIREMENTS OR EXPECTATIONS OF ANY PERSON, ARE ERROR-FREE, RELIABLE, OR WILL OPERATE WITHOUT INTERRUPTION, OR THAT ANY ERRORS OR DEFECTS REPORTED TO CALLFLY WILL BE CORRECTED. THE SERVICES MAY BE SUBJECT TO LIMITATIONS, DELAYS, AND OTHER PROBLEMS INHERENT IN THE USE OF THE INTERNET AND ELECTRONIC COMMUNICATIONS. CALLFLY IS NOT RESPONSIBLE FOR ANY DAMAGES RESULTING FROM SUCH PROBLEMS.

Privacy

CallFly (Crater Creative, LLC) is not in the business of selling your data, conversations, or recordings. We collect as little information as we can and share it only with the service providers needed to provide our service.

What data do we collect

When you make a call, CallFly collects the phone number(s) involved in the call in order to connect you. When the call is over, the call recording is stored as well as metadata such as the duration of the call.

If a call is unlocked (i.e. you pay to access the recording), CallFly uses Stripe to process you payment. Stripe collects your payment information and email address, when is then associated with a call in CallFly.

Like most websites, CallFly collects basic information about each computer/web browser that visits https://CallFly.app, even if you don’t make a call.

What we do with your data

Your data is used to provide the CallFly service and to facilitate billing and payments. This means the call data is shared with 3rd party service providers, such as for telephony, payments, web hosting, et al, as necessary to facilitate CallFly’s service.

What we don’t do with your data

We do not access your data unless directed by you to support an issue, or incidentally in the course of maintaining or diagnosing problems in CallFly itself. In either case, we do not access recordings or transmit them.

Who can access your data

Besides CallFly itself to provide our service, only you. Access to call data is granted only when access to/ownership of the phone number used to make the relevant call has been verified.

CallFly will respond to legal, verified requests for data from law enforcement agencies as required by applicable law.
